Terms of Service

These Terms of Service ("Terms") govern your use of ProCourt ("the Service"), operated by ProCourt Inc. By using the Service, you agree to these Terms.

1. Use of Service

ProCourt provides on-device tennis stroke analysis and progress tracking. Tennis players of all ages are welcome. If you are under the age of 18 (or the age of majority where you live), you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. If you are under 13, a parent or legal guardian must set up and manage your account and consent to your use of the Service and to our processing of your information as described in our Privacy Policy.

2. Accounts

You are responsible for maintaining the security of your account and all activity under it. You must provide accurate information when creating your account.

3. Subscriptions

ProCourt Premium is a paid subscription, offered as a monthly plan or an annual plan. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Pricing is subject to change with notice.

Depending on where you subscribe, billing is handled either by Apple (in-app purchase) or by our web payment processor. You can manage or cancel your subscription through the App Store (for in-app purchases) or through your account on our website (for web purchases). Amounts already paid are non-refundable except where required by law or by the applicable app store's policies.

Fair use. Premium includes a set number of session analyses per billing period (currently 50 per month). Features described as "unlimited" (such as pro stroke comparisons, feedback, and progress tracking) are subject to reasonable fair-use limits that prevent abuse and protect the Service, including a cap of up to 100 strokes analyzed per session. These limits are set well above normal individual use. We may adjust fair-use limits with notice.

4. Content

You retain ownership of videos and content you upload. By uploading content, you grant ProCourt a license to process it for the purpose of providing the Service.

5. Intellectual Property and Restrictions

The Service, including its software, source code, algorithms, models, design, text, graphics, and other materials (other than content you upload), is owned by ProCourt Inc. and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service for your own non-commercial use.

You agree that you will not, and will not allow others to:

• reverse engineer, decompile, disassemble, or otherwise attempt to discover or derive the source code, underlying ideas, algorithms, or structure of the Service or any part of it;
• copy, modify, adapt, translate, or create derivative works based on the Service;
• extract, scrape, mine, or reproduce the Service, its models, or its data by any means;
• remove, obscure, or alter any copyright, trademark, or other proprietary notices; or
• circumvent, disable, or interfere with any security, licensing, or access-control features of the Service.

"ProCourt", the ProCourt logo, and related names and marks are trademarks of ProCourt Inc. and may not be used without our prior written permission.

6. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Limitation of Liability

ProCourt is provided "as is" without warranties. We are not liable for any indirect or consequential damages arising from your use of the Service.

8. Changes

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
